This affects the commission\u2019s lawsuit against Ripple Labs and its executives.<\/strong><\/p>\n<h2>SEC\u2019s Conflicts of Interest Involving Bitcoin, Ether, <a class=\"lar-automated-link\" href=\"https:\/\/markets.bitcoin.com\/crypto\/XRP\">XRP<\/a>, Ripple<\/h2>\n<p>Empower Oversight Whistleblowers &amp; Research (Empower Oversight) announced Wednesday that it has submitted a detailed request under the Freedom of Information Act (FOIA) to the U.S. Securities and Exchange Commission (SEC) \u201cseeking communications between SEC officials and their current and former employers.\u201d<\/p>\n<p>Empower Oversight is \u201ca nonprofit, nonpartisan educational organization dedicated to enhancing independent oversight of government and corporate wrongdoing,\u201d its website describes. The organization \u201cworks to help insiders document and report corruption to the proper authorities while also seeking to hold authorities accountable to act on those reports.\u201d<\/p>\n<p>In his <a href=\"https:\/\/empowr.us\/wp-content\/uploads\/2021\/08\/2021-08-12-JF-to-SEC-FOIA.pdf\">letter<\/a> to acting Chief FOIA officer Olivier Girod, Empower Oversight founder Jason Foster wrote: \u201cWe write today seeking information regarding the appearance of conflicts of interest by former high-level officials at the SEC relating to cryptocurrencies.\u201d<\/p>\n<p>The government watchdog explained that from May 2017 to December 2020:<\/p>\n<p>Senior SEC official William Hinman reportedly participated in the SEC\u2019s regulation of cryptocurrencies while receiving millions of dollars from his former employer, the law firm Simpson Thacher.<\/p>\n<p>The group explained that \u201cSimpson Thacher is a part of the Enterprise Ethereum Alliance, an industry organization whose objective is to drive the use of Enterprise Ethereum.\u201d<\/p>\n<p>Furthermore, Empower Oversight alleged that \u201cHinman, while in his capacity at the SEC, declared that the Ethereum cryptocurrency, ether, was not a security, causing its value to rise significantly,\u201d adding:<\/p>\n<p>Later, the SEC sued one of Ethereum\u2019s competitors, Ripple, declaring its cryptocurrency, <a class=\"lar-automated-link\" href=\"https:\/\/markets.bitcoin.com\/crypto\/XRP\">XRP<\/a>, was a security. Shortly thereafter, <a class=\"lar-automated-link\" href=\"https:\/\/markets.bitcoin.com\/crypto\/XRP\">XRP<\/a>\u2019s value plummeted 25%.<\/p>\n<p><!-- growjs zone placement 31 -->    <!-- end of growjs zone placement --> <\/p>\n<p>Noting that after Hinman left the SEC in December 2020, he returned to Simpson Thacher as a partner, Empower Oversight added that \u201cThe leader of the SEC division that brought the <a class=\"lar-automated-link\" href=\"https:\/\/markets.bitcoin.com\/crypto\/XRP\">XRP<\/a> lawsuit, Marc Berger, similarly left the SEC for Simpson Thacher.\u201d<\/p>\n<p>The announcement also mentioned former SEC Chairman Jay Clayton and how he handled cryptocurrency issues while heading the securities regulator. It details:<\/p>\n<p>As with Mr. Hinman and ether, while at the SEC, Mr. Clayton declared that bitcoin wasn\u2019t a security, and its value rose.<\/p>\n<p>The government watchdog emphasized that the SEC\u2019s <a href=\"https:\/\/news.bitcoin.com\/ripple-wins-discovery-judge-grants-access-sec-internal-records-bitcoin-ether-xrp\/\">lawsuit against Ripple<\/a> and its executives over the sale of <a class=\"lar-automated-link\" href=\"https:\/\/markets.bitcoin.com\/crypto\/XRP\">XRP<\/a> was filed at the end of Clayton\u2019s tenure at the commission.<\/p>\n<p>Moreover, after leaving the SEC, Clayton joined <a href=\"https:\/\/news.bitcoin.com\/1-billion-bitcoin-ether-one-river-hedge-fund-increase-holdings-600-million\/\">One River Asset Management<\/a>, a cryptocurrency hedge fund exclusively focused on bitcoin and ether, Empower Oversight noted.<\/p>\n<p><em><strong>Do you think there were conflicts of interest regarding how the SEC treated bitcoin, ether, and <a class=\"lar-automated-link\" href=\"https:\/\/markets.bitcoin.com\/crypto\/XRP\">XRP<\/a> as well as its lawsuit against Ripple?
